TN v. T.M.

Despite having the entire family in the next room and absolutely no forensic findings, a grandfather is accused of Rape of a Child against his granddaughter. Without an attorney, he attends a police interrogation hung over and tells the police that he can’t remember what happened the night before. The State offered twenty-five years, but he went to trial and was found not guilty of Rape of a Child, but guilty of lesser offense Aggravated Sexual Battery. The appellate court concedes that the trial judge made numerous evidentiary errors.
